1. Introduction
Welcome to the Native American History: An Ethnic Studies Curriculum From Home (the “Course”), provided by the California Curriculum Center (“CCC,” “we,” “us,” or “our”). By purchasing and accessing this Course, you (“user,” “you,” or “your”) agree to be bound by these Terms and Conditions (the “Terms”). Please read these Terms carefully before using the Course. If you do not agree with these Terms, do not access or use the Course.

2. Subscription and Access
Subscription Basis: The Course is offered on a subscription basis with a one-time purchase, providing access for one year from the date of purchase.

Account Creation: Users must create an account with a unique username and password to access the Course materials. Users are solely responsible for maintaining the security and confidentiality of their login credentials.

Single User Policy: Each account is intended for use by one student only. Parents may use the student’s account to monitor progress, but only one student may use the account for course activities.

Device Access: Access to the Course is permitted from multiple devices using the same login credentials; however, only one student is allowed per account.

3. User Responsibilities
Security: Users are responsible for maintaining the security of their login credentials. Sharing login information with others is prohibited.

Account Use: Each account is for individual student use only. Multiple students sharing a single account are not allowed.

Parent Responsibilities: Parents are responsible for grading subjective work (e.g., essays, short answers) and determining the final grade for the course. The Course provides auto-graded multiple-choice quizzes but no live instruction or feedback.

4. Content Usage
Prohibited Actions: All Course content, including text, graphics, multimedia, and quizzes, is protected by copyright and may not be copied, downloaded, shared, or reproduced in any form without express written permission from CCC.

Access Duration: Users have access to the Course materials for one year from the date of purchase. Upon expiration, access will be terminated unless the subscription is renewed or a new account is created.

5. Refund and Cancellation Policy
Refunds: Refunds are available within 48 hours of purchase. To request a refund, visit the account management page. Refunds will not be issued if the user has accessed more than 30% of any Course element (e.g., readings, quizzes).

No Refunds After 48 Hours: After 48 hours from the time of purchase, no refunds will be provided under any circumstances.

6. Liability and Disclaimers
No Guarantee: CCC does not guarantee the accuracy or completeness of the course content and disclaims any liability for errors or omissions. While the Course is designed to align with the California Ethnic Studies Model Curriculum, CCC cannot guarantee that it will meet the requirements of any specific educational institution, including charter schools, which may have their own standards for graduation.

Educational Outcomes: CCC does not guarantee any specific educational outcomes or academic achievements resulting from the use of this course.

7. Intellectual Property
Ownership: All Course materials, including but not limited to text, graphics, quizzes, and multimedia content, are the exclusive property of the California Curriculum Center and are protected by copyright laws. Unauthorized use, reproduction, or distribution of these materials is strictly prohibited.

8. Data Collection and Privacy
Data Collected: CCC collects standard user data during account registration and course participation, including but not limited to contact information and course progress. User information will never be sold or distributed to any other party. Billing information will be retained only as necessary to process the one-time fee and issue refunds if applicable.

Data Protection: CCC will not share user data, including contact information or academic progress, with third-party vendors. The CCC does not provide provisions for data deletion or correction.

9. Course Modifications
Right to Modify: CCC reserves the right to modify, update, or enhance the course content at any time without prior notice. Changes may be made to improve the Course and ensure alignment with current educational standards.

10. Jurisdiction and Governing Law
Jurisdiction: These Terms and any disputes arising from or related to the Course will be governed by and construed in accordance with the laws of the State of California, without regard to their conflict of law principles.

Dispute Resolution: Before pursuing any legal action, users agree to provide CCC with an opportunity to resolve any disputes through informal negotiation. Users must contact CCC with a detailed description of the issue and allow CCC 30 days to attempt to resolve the dispute. If the dispute cannot be resolved informally, users agree to pursue mediation or arbitration before initiating litigation.
